Model Releases and IDs

  • We are not lawyers and we cannot give legal advice. Our policies and procedures as described on this website are based on our best understanding of the laws and regulations. However, we STRONGLY URGE you to consult with a legal professional in your area on all legal matters.
  • USA law requires that producers obtain a signed model release and a legible copy of a valid ID for every performer appearing in every film.
  • Under the recently amended law there is no longer a distinction between Primary Producer and Secondary Producer. A person is either a Producer or he is not. Although we disagree, the law clearly views AMVC as a "Producer" because we duplicate your films to fill orders and because we maintain a website with images from your films. As such, we are REQUIRED to maintain copies of your model documentation.
  • We are often asked if the cameraman also has to submit a release and ID. If the cameraman or any part of the cameraman appears in the film (such as a mystery hand reaching in to jack off a model or fondle a breast) then the answer is YES. We urge you to send in clear copies of all of your model documents. You may choose not to send in your model documentation, but you will leave yourself vulnerable to being pulled from the market if the government once again amends the 2257 laws and regulations.
  • You are also required to maintain an index file of the performers in the film. Your index file should be an EXCEL spreadsheet formatted document like this example. You can right-click that link and select ''Save Target As'' to save the template to your computer. If you do not have EXCEL then you can use a Google Spreadsheet for free and it will allow you to export files in .xls format. Please send us the data file itself, not a print out on paper, as we will integrate your data into the master index file that we maintain for all AMVC listed films.
  • We are required to keep records of who your Custodian of Records is. To accomplish this we have created a 2257 Compliance Form that you will need to print out and mail in with each film you send to us. Documentation Requirements

The 2257 rules spell out how you have to maintain your records to prove every model is eighteen or older. They are complex and detailed, but the biggest part of them deal with the model ID. You have to get a clear and legible copy of the model ID for every performer you work with.
  • If you are a USA based producer shooting sessions in the USA then the ID has to be issued by the US Government or a state government (or Washington DC), have the photo, name, and birthdate of the performer, show a document number so the inspectors can access an original document from the issuing authority if they choose to do so, and the ID must not be expired atthe time of filming. The common examples are: USA Passport, USA Green Card, State Driver's License, State ID Card, USA Military ID.
  • If you are a USA based producer shooting sessions outside of the USA then you may accept model IDs from any country as long as the IDs meet the same standards as a US ID, i.e. it must be issued by a federal governement or a state/territorial/provincial goverment, have the photo, name, and birthdate of the performer, and show a document number so the inspectors can access an original from the issuing authority. The common examples are: Passport, Citizen ID Card, Driver's License, Voter Registration, Military ID. In such cases, please complete an Affidavit for Filming Outside of the USA form and send it in with the film.
  • If you are a producer NOT based in the USA then you may accept model IDs from any country as long as the IDs meet the same standards as a US ID, i.e. it must be issued by a federal governement or a state/territorial/provincial goverment, have the photo, name, and birthdate of the performer, and show a document number so the inspectors can access an original from the issuing authority. The common examples are: Passport, Citizen ID Card, Driver's License, Voter Registration, Military ID.
  • To repeat: The ID has to have a recent and recognizable photo of the model, the model's name, the model's birthdate, the document number, and the ID must not be expired at the time of filming.
  • The model has to provide a list of all of their known aliases, maiden names, stage names, and nicknames.
  • Perhaps most important of all, the copy you make of the ID MUST be legible. In fact it must be legible enough for you to make clear copies of that copy because you will probably have to supply copies of that ID to every vendor who sells or streams your film and every website that posts images taken from your film. We suggest making a high resolution color scan of the front and back of every ID for every performer so that you can print a new copy each time you need it.

International Producers

You must follow all the same USA laws as everyone else since the films will be sold in the USA. All of the laws, rules, and policies above apply equally to you.

Here's a special note though just for foreign producers: One provision of the law requires that the ID have a recent and recognizable photo of the performer. We've noticed that many times a foreign national will get a passport when they are in their early teens and keep that passport with that teen photo for years and years and years. At some point that photo is not recognizable as the performer. In that case, the passport is no longer a valid ID for 2257 documentation and you'll need to have the performer provide a different valid ID.
